Kendall Speaks at Join the Impact: National Protest Against Proposition 8
The following is the text of the remarks given by CLCR member Ryan M. Kendall at the Join the Impact: National Protest Against Proposition 8 - Saturday November 15th, 2008 at 11:30 AM at the City and County Building, Denver, Colorado,
We come together today as fellow Americans in the movement to end injustice and hatred. We have gathered on this day a diverse array of people united in the common cause of Liberty. On November 4th of this year, America witnessed a transformative event in the election of the first African American to the Presidency. More than any other occurrence in this century, the election of Barack Obama as President of the United States serves as a symbol and reminder of how far this country has come from the era of discrimination based on race. Yet on the very same day as this historic milestone, the Citizens of three states, Arizona, Florida, and California, affirmed another form of segregation and prejudice by passing bans on Equal Marriage Rights. Similar bans have been passed, not in a few states, but in thirty, sadly, including ours.
By these legislative acts of the People, and particularly in the case of California’s Proposition 8, we have seen the use of Laws and Constitutions as tools of intolerance—enshrining bigotry within the most sacred and supreme laws of our land. We have taken documents of principle, solely designed to protect the Rights of the People and Limit the Authority of government, and turned them into weapons in a cultural war—a war that is damaging to the fabric of our society, a war that is an affront to our basic decency, and needlessly painful to millions of Americans in this great Nation.
In one of our most precious founding documents, the Declaration of Independence, we find words often quoted yet less often understood--words that declare the truth of our equality, and assert that we are endowed by our Creator with certain inalienable Rights. While frequently invoked, the power and significance of these words, these ideas, is seldom fully appreciated.
The preservation and respect of Human Rights has been the great challenge of our times, and we are called to continue on the path of Freedom. The very essence of Natural Rights is that they are inherent to the individual. It is our status as people from which these Rights are derived, and nothing else--rights that are not subject to the approval of others, that do not depend on the recognition of the government, and that cannot be revoked because of another's differing philosophy. Yet today, we live in a world where our Rights are denied us, taken away because of disagreement and ignorance. We summon all people to recognize the fundamental, inviolable freedom of others. No matter your affiliation, opinion, belief, religion, or perspective on what the world should be, you must allow others to live in their own freedom, to exercise control over their own lives, and accord them the respect and courtesy that you so casually demand--even if you do not agree with, support or condone their way of life. Allowing your personal beliefs to strip others of their own Rights, deny them equality under the laws of a secular society, and instead force them to comply solely with your vision of reality, is an unspeakable offense. We have only before witnessed such cruelty in the acts of dictators and totalitarian regimes. Let the United States be a nation of true liberty not conditional upon a majority's, or any other faction's consent.
Freedom, Liberty, Natural Rights--these are not the only words associated with our cause; there are others--Marriage, and namely, Love. There is such injustice already in our daily lives and the world is most assuredly an imperfect place. We cannot explain the wars or violence, the disease, indignity, and evil. There is no way to justify the already unjust. How then can a blighted world reject the rare and precious gift of Love? Love, no matter who shares it, is the noblest act and highest calling of humanity. How can a society so plagued with difficulties show such disdain for so great a miracle? It is a moral failing that I will never understand.
At times, we are treated so differently merely because we are gay, bisexual, lesbian, or transgendered. We are misunderstood and there is a lack of tolerance and common empathy towards us. To all those listening, let me explain the GLBT community as best I can: We are people, the same as you, with all of the same hopes, dreams, and challenges in life as any others. We seek out relationships that fulfill us, as do you, not as a choice but a necessity. The qualities that we share with the wider world bind us all together far more tightly than our differences could ever divide us. We share a common destiny, linked with the fate of all humanity, and it is in the way that people treat each other that history will measure our integrity and character. Let us bear the judgment of these future generations well.
Courts have seen the obvious truth, that marriage is a fundamental right of all people, and that it cannot be denied because of differing sexuality. No distinction can reasonably be made between loving, committed partners. We are told that Civil Unions are enough, and they are a beginning, but the ideology of Separate but Equal has rightly been cast aside. One could argue that we are indeed entitled to marry, as long as it is a member of the opposite sex. This argument has faced us before, and before it has been rejected. In 1948, in the case of Perez V. Sharp, the California Supreme Court was asked to rule on a ban against interracial marriage. The court held the ban unconstitutional, declaring that, "The Right to Marry is the Right to marry a person of one's own choosing." We only ask for the same consideration.
To those who oppose us: Please understand that this is not about you or your values, this is about us and our lives. We are not trying to alter the world in which you live, only to live fully in the world that we inhabit. We seek nothing but the Justice of Equality and the Fairness of Individual Freedom.
In the end, marriage is about Love, not certificates, not contracts, not words on paper, but Love, and in this sense, it can never be taken away from us. Thank you.
